Each year the smaller authority’s Annual Governance and Accountability Return (AGAR) needs to be reviewed by an external auditor appointed by Smaller Authorities’ Audit Appointments Ltd.  The unaudited AGAR has been published with this notice. As it has yet to be reviewed by the appointed auditor, it is subject to change as a result of that review.

Any person interested has the right to inspect and make copies of the accounting records for the financial year to which the audit relates and all books, deeds, contracts, bills, vouchers, receipts and other documents relating to those records must be made available for inspection by any person interested. For the year ended 31 March 2020, these documents will be available on reasonable notice by application to:

Sevenoaks District Council has been granted permission to bring a judicial review against the Planning Inspector’s decision to reject the draft Local Plan.

Local Plan set to have its day in court

 

Sevenoaks District Council has been granted permission to bring a judicial review against the Planning Inspector’s decision to reject the draft Local Plan.

The High Court issued a notification on Tuesday 2 June 2020 granting permission for the review. The Honourable Mr Justice Swift concluded all grounds for the Council’s claim are arguable and permission for judicial review was granted, clearing the first hurdle of the process.

On 2 March 2020, the Planning Inspector wrote the final report on the examination of the Sevenoaks District Local Plan. It concluded the Plan was not legally compliant in respect of the Duty to Co-operate.

However, the Council strongly rejected this conclusion, which only surfaced after the first round of the Local Plan hearings in October, seven months after the Council had submitted the Plan and supporting evidence to the Inspector.

Within the Local Plan submission, there were more than 800 pages of evidence setting out how the Council had worked with its neighbours during the production of the Plan. The neighbouring councils and other organisations involved in the development of the Plan supported the Council’s evidence and approach on this matter.

In April, the Council began Judicial Review proceedings to overturn the Inspector’s decision.

Cllr Julia Thornton, the Council’s Cabinet Member for Development & Conservation, says: “This is great news as it means the High Court believes our position that the Planning Inspectorate may have a case to answer. This is an important first step to getting our Local Plan approved.

“We firmly believe we had followed the relevant guidance when we developed the plan. The evidence we provided to the Planning Inspector backs this up.

“In our opinion, the Planning Inspector has incorrectly interpreted key parts of the Local Plan requirements.

“Taking court action is not something we would take lightly, but we feel we have no choice.”

The High Court decision followed the news that the three MPs who represent the Sevenoaks District wrote to Robert Jenrick MP, the Secretary of State for Local Government, on Monday (1 June). Laura Trott MP, Tom Tugendhat MP and Gareth Johnson MP urged the Minister to use his powers to reconsider the Planning Inspectorate’s reasons for rejecting the draft Local Plan.

Cllr Thornton, adds: “Our MPs recognise we have produced a robust Local Plan to provide the right type of developments in the right place, at the right time. They share our concerns about the handling of the Local Plan examination. We’re grateful for their support and we hope this moves the Plan forward.”

EDENBRIDGE HOSPITAL – CLOSED

The minor injury unit (MIU) and x-ray department at Edenbridge and District War Memorial Hospital Minor is temporarily closed from 6pm this evening for the foreseeable future.

 

Your nearest MIU is at Sevenoaks Hospital. This is open from 8 am to 8pm, seven days-a-week.

 

As the local Edenbridge community is following the Government’s guidance on social distancing, there has been a significant reduction in people using the minor injury unit at Edenbridge.

 

That’s why, to support our work around COVID-19, we are temporarily moving staff from Edenbridge during these unprecedented times.

Hever Parish Council meeting tomorrow, at Hever village hall, Tuesday 17th March has been cancelled due to insufficient numbers of Councillors being able to attend (for a variety of reasons). Items will be transferred to the next scheduled meeting in May.

i               permission for the memorial bench for Pat Leigh at Four Elms village pond.  No request for funds.

ii              Stop fishing at the pond immediately – amount of rubbish being left and dangerous parking.

iii             complete obstruction of pavements by cars that are parked, not only from people that fish also from parents picking up their children.  Those that walk are having to walk in the road with their children.

iv             parking on double yellow lines, again mostly visiting fishermen

v              speeding through the village by motorists, 2 accidents on the crossroads already this year

  1. Request for a fence to left hand side of Four Elms pond to deter fishermen accessing the garage site for fishing?

  1. Resignation of Christine Thompson. Opportunity for co – option for Four Elms ward Councillor, IF no election is called by 10 electors by 27th March.

The Council to consider which networks a Cllr. could be co – opted from.

 

5i.        *Financial update. Receipts and payments since last update & accounts and statement reconciliation (Clerk).

5ii.       To consider any grant applications received.  Does the Council require further information and / or wish to support the application (to what sum)?

*£ 5,000 requested for funding for our new pavilion and decking.  Falconhurst Cricket Club.

  1. Gatwick update (SL, RBS, DL). Clerk to report back from attendance at Roundtable meeting regarding Gatwick Northern Runway Project – 19th February 2020.

  1. HPC Affordable Housing Project.

To receive analysis by Sevenoaks District Council on possible rural affordable housing exception sites in the parish and update following a meeting in December between the HPC working party (Clerk, SS, CT) and English Rural Housing association.  Landowner negotiations would be the responsibility of English rural.  A period of full and comprehensive public consultations would take place before HPC consider whether to formally support the project.  Only after this time, could any planning application be considered.  Need to initially consult with KCC Highways for their guidance.

Pedestrian safety request from Governors to consider re-routing path from Castle coach park to Hever school – to pass in front of hut.  They have obtained quote for most of the work and able to part fund from Governors fund.
